These terms and conditions (the “Terms of Use”) regulate your (the “User”) access to and/or use of all websites controlled by Lechia, Inc (“Lechia”) where these Terms of Use are posted (the “Sites”).
From the time users access the Sites, they are subject to the Terms of Use. Anyone who does not accept these Terms of Use must refrain from accessing the Sites, either directly or indirectly, and from using any information or service provided by the Sites.
ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION AGREEMENT SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND LECHIA WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Definitions. For the purpose of the Terms of Use, the following terms shall have the meaning defined below.
“Related Party”: means any affiliates, entities which control Lechia, are under common control with Lechia and/or subsidiaries of Lechia.
“Service Providers”: means any third party service providers, that are not a Related Party, that may perform certain services for Lechia, such as website hosting, order fulfillment, delivery of Lechia’s promotional materials and product offers, clearing and processing credit and debit card payments, or performing other services on Lechia’s behalf.
“Third Party Websites”: means websites or locations that are operated and controlled by third parties other than Lechia or its Related Parties.
“User” or “Users”: any person that accesses and/or uses the Sites.
Ownership and Operation. The Sites belong to Lechia. For more information on Lechia, our product brands, please visit, www.lechia.co. The User agrees and acknowledges that the Sites are available for his/her personal and non-commercial use. The User further agrees that the Sites are the property of Lechia, including all intellectual and industrial property rights arising from or included in the Sites, and that User has no right to use the Sites except as provided in these Terms of Use.
Lechia will not be liable for any loss or damage the Users suffer in connection with any use of the Sites for commercial or other purposes not authorized under these Terms of Use. Lechia may deny or terminate the User’s access to the Sites at its sole discretion. The provision of the Sites is free of charge and, on this basis, Lechia has no maintenance or support service obligation and is not liable for any loss or damage that the User may suffer as a result of a failure to maintain or update the Sites.
The User may not copy, modify or reuse the Sites, updates to the Sites or any component of the Sites, including software incorporated into the Sites. The User may use the Sites for lawful purposes and in accordance with these Terms of Use. Upon acceptance of these Terms of Use, Lechia hereby grants Users a revocable, non- transferable and non-exclusive license to view, print and distribute the content of the Sites for personal and non-commercial purposes only provided that the User does not remove or obscure the copyright notice or any other notice contained in the content of the Sites. The User may not copy, reprint, modify, display, develop, translate, distribute, adapt, transmit, communicate to the general public by telecommunication means, disclose or sell the content from the Sites in any manner, for any commercial use or disclose it to any third party for commercial purposes, including other websites, without the prior written consent of Lechia.
Additionally, the User agrees not to (i) use the Sites in any way that could damage, disable, overburden or impair the Sites, or interfere with any other User’s use of the Sites; (ii) use any robot, spider or other automatic device, process or means to access the Sites for any purpose, including scraping, data mining, monitoring or copying any material from this Site; (iii) use any manual process to monitor or copy any material from the Sites, or for any other unauthorized purpose without the prior written consent of Lechia; (iv) use any other device, software or routine to interfere with the proper working of the Sites; (v) violate any law or regulation, including, without limitation, any applicable export control laws, privacy laws or any other purpose not reasonably intended by Lechia; (vi) jeopardizes the security of users registration information or anyone else’s (such as allowing someone else to log in to the Sites as user); (vii) attempt, in any manner, to obtain the password, account, or other security information from any other user; or (viii) attempt to interfere with the proper working of the Sites in any other way.
Acceptance of these Terms of Use. Any access to the Sites, directly or indirectly, or use and/or download of information from the Sites implies that the User accepts these Terms of Use.
Changes to the Information. Lechia reserves the right and ability to update, modify or remove, in part or in whole, any content or information posted on the Sites in its sole discretion at any time and without prior notice to User. For clarity, this right extends to content referring to availability or stock of products or services, specifications, price, or the configuration and functionalities of the Sites. Furthermore, Lechia may unilaterally modify the structure and design of the Sites, as well as modify or eliminate any products, services, content and conditions of access and/or use of the Sites in its sole discretion at any time and without prior notice to User.
Eligibility and Access. The access to and use of the Sites by minors, in accordance with current legislation, is the responsibility of such minors’ respective parents, legal guardians or representatives.
Lechia may limit the access to certain parts of the Sites and/or specific Services to users aged 18 and over. In said case, Lechia shall clearly identify those parts of the Sites or those Services where access is limited together with the applicable terms of use. Notwithstanding the foregoing, Lechia may deny access to the Sites and/or the Services at its sole discretion at any time and without prior notice to Users.
Children’s Online Privacy Protection Act. The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13 years of age. We do not knowingly collect or solicit personally identifiable information from children under 16 years of age; if you are a child under 16 years of age, please do not attempt to register for or otherwise use the Services or send us any personal information. If we learn we have collected personal information from a child under 16 years of age, we will delete that information as quickly as possible. If you believe that a child under 16 years of age may have provided us personal information, please contact us at hello@lechia.co.
Registration. To have access to certain functionalities of the Sites, the User may be asked to make a specific registration. If the User wishes to register, even if such registration is not mandatory, the User must provide their personal information in the corresponding fields. Personal information includes, by way of example, but not limited to, full name, identity document, date of birth, phone number, home address, and email address.
User represents and warrants that user is an individual of legal age to form a binding contract (or if not, user received a parent’s or guardian’s permission to use the Sites and has gotten a parent or guardian to agree to these Terms of Use on user’s behalf). When registering on the Sites, it is important that the User provides accurate, complete and updated information and agrees to update such information, as appropriate, to keep it as accurate as possible. The User must enter an email and create a personal and non-transferable password to log into the Sites. The username and password are confidential, and the User must take the necessary precautions and measures to avoid misuse by third parties.
The User is solely responsible for the access and activities carried out on the Sites, and must immediately inform Lechia in case of misuse or unauthorized access and use by third parties. In case of loss or theft of the access password, the User must immediately request a change of the password on the Sites. If said request is not possible for any reason, the User must notify Lechia, and User shall remain responsible for all actions on or related to the Sites.
User will only use the Sites internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to use. If user’s use of the Sites is prohibited by applicable laws, then user isn’t authorized to use the Sites. Lechia can’t and won’t be responsible for users using the Sites in a way that breaks the law.
Contact. In the event that the User wishes to contact Lechia, Lechia will ask for the reason of the contact, personal information such as first and last name, e- mail address and country, as well as a message explaining the reasons for the contact. As part of the contact process, Lechia may request a username and password. The User agrees to provide accurate and complete information when contacting Lechia. The User authorizes Lechia to store and use his or her information for the purposes set forth in these Terms of Use in order to respond to the User’s requests.
Privacy. In compliance with applicable laws in any applicable jurisdiction, and in order to protect the security of the Users’ personal data, the data that the User provides to Lechia through our Sites are subject to our Privacy Policy, available at www.lechia.co.
Ownership and Use of Sites’ Materials, Products and Services. Lechia owns the intellectual property rights for all of the materials on the Sites. Lechia also owns or has a valid right to use all trademarks, service marks, graphics and logos used on the Sites. Unless expressly stated, no part of the Sites may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial use, provided you keep intact all copyright, trademark, and other proprietary notices on the materials. Any use, reproduction, republication, upload, posting, transmission, modification of the materials or use of the materials for any other purpose is a violation of Lechia’s intellectual property rights and proprietary rights. The use of any such material(s) on any other website or computer network without Lechia’s written consent is strictly prohibited. Your use of the trademarks, service marks, graphics and logos on the Sites in any manner other than as authorized in these Terms of Use, or as authorized in writing by Lechia, is strictly prohibited.
Cost. The Sites are currently free, but Lechia reserves the right to charge for some or all services in the future. Lechia will notify you before any services you are then using become subject to a fee. If you thereafter continue to use such services, you must pay all applicable fees for such services.
Consent. The User hereby grants Lechia all consents required pursuant to any applicable law in any applicable jurisdiction, which may be required for the use by Lechia, its Related Parties, Affiliates and/or Service Providers, in accordance with these Terms of Use for the Personal Information processing in accordance with the Privacy Policy available at www.lechia.co.
Geographic Scope of the Sites. Lechia controls and operates the Sites from the United States of America.
Third Party Links. There may be hyperlinks on the Sites to Third Party Websites. These links are provided solely for the Users’ convenience. No information, material or content of third parties contained in, referenced by, included in, or linked to or from the Sites implies Lechia’s endorsement of the products, services or information of the third parties. Any information, data, opinions, recommendations, products or services provided by such third parties, whether through links to other websites or directly through their websites, are solely those of the third parties and not of Lechia. User’s use of Third-Party Websites is subject to the terms of use and privacy policies of those Third Party Websites.
Exclusion of Warranties regarding the Use and Functioning of the Sites and Links visible in it. The material available on the Sites is provided AS IS, without conditions or warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, User disclaims all conditions and warranties, express or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title and non- infringement. Lechia makes no warranty that (i) the Sites will meet User requirements; (ii) access to the Sites will be uninterrupted, timely, secure, free of viruses, worms, trojan horses or other harmful components, or free of defects or errors; (iii) the results that may be obtained from the use of the Sites will be accurate or reliable; or (iv) defects will be corrected. The User understands and agrees that any material and/or data downloaded or otherwise obtained through the Sites is used at User’s own risk and that User will be solely responsible for any damage to User’s computer system or loss of data that results from the download of such material and/or data., The material on the Sites may include technical inaccuracies or typographical errors and may be inaccurate or become inaccurate as a result of developments after their respective dates. Lechia undertakes no obligation to verify or maintain the currency of such information.
Lechia is not responsible in any way for those contents, commercial activities, products and services included that could be viewed through electronic links (links), directly or indirectly, through the Sites, especially those that could correspond to value-added content for the User, such as leisure, entertainment, curiosities, advice or others. The presence of links on the Sites, unless expressly stated otherwise, is merely for information purposes and in no case implies a suggestion, invitation or recommendation about them. These links do not represent any type of relationship between Lechia and the individuals or companies that own the websites that can be accessed through these links. Lechia reserves the right to unilaterally remove the links that appear on the Sites at any time.
Limitation of Liability. Subject to applicable law, under no circumstances shall Lechia, its Related Party, Affiliates and/or Service Providers, and each of their licensors or licensees, be liable to the User for any direct, indirect, special, incidental, consequential, punitive or other damages, including lost profits, personal injury (including death) and property damage, that may result from (i) the use of, or the inability to use, the Sites or any material on the Sites; (ii) the conduct of any other User or third party of the Sites; (iii) the unauthorized access to or amendment of the Personal Information of the User; (iv) and any other matter related to the Sites. Lechia shall not be liable even if Lechia or an authorized representative of Lechia has been advised of the possibility of such damages. These include but are not limited to damages or injury caused by error, omission, interruption, defect, failure of performance, delay in operation or transmission, line failure or computer virus, worm, trojan horse or other harmful component.
In the event that applicable law may not allow the exclusion of certain warranties or the limitation or total exclusion of liability in which case the above limitation of liability shall be construed to the maximum extent permitted by law.
Indemnification. User hereby agrees to indemnify and hold Lechia and its Related Party, its Affiliates and/or Service Providers, and each of their respective agents, licensees, successors and assigns, harmless from and against any and all claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses, including reasonable legal fees, relating to or arising out of your use of the website, any use of your User Submissions as permitted in these Terms of Use, and/or any breach or alleged breach of any of your warranties, representations or agreements hereunder.
Termination. The duration of the Terms of Use is indefinite. Notwithstanding the foregoing, Lechia may interrupt, suspend or terminate the provision of the service of the Sites or any of the services that comprise it, without expression of cause.
Assignment. User may not assign, delegate or transfer these Terms of Use or Users rights or obligations hereunder, in any way (by operation of law or otherwise) without Lechia’s prior written consent. Lechia may transfer, assign, or delegate these Terms of Use and our rights and obligations without consent.
Changes to the Terms of Use. Lechia may, from time to time, change or revise these Terms of Use, along with its products, at its sole discretion by updating this posting on the Site, and indicating the date of application of the new version of the Terms of Use. The date of the “Last Update” included at the end of this legal notice shall indicate when the changes have been made. Your use of the Site and your participation in the application process reaffirms your continuing agreement to the then-current Terms of Use. If you don’t agree with the new Terms of Use, you are free to stop using the Sites. If you use the Sites in any way after a change to the Terms of Use is effective, that means you agree to all of the changes.
Applicable Law and Jurisdiction. These Terms of Use, as well as the relation between User and Lechia, shall be governed by and construed in accordance with the laws of the State of Delaware.
Conflict Resolution. The User hereby (i) agrees that any action at law or in equity arising out of or relating to these Terms or Lechia’s Privacy Policy, including without limitation, the user’s use of the Services (including the Program), or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability to arbitrate such dispute, claim, or controversy, shall be filed only in the state or federal courts of Delaware, and (ii) consents and submits to the exclusive jurisdiction and venue of such courts. No action arising under or relating to these Terms or Lechia’s Privacy Policy may be brought by either party more than one year after the cause of action has occurred. AT THE SOLE DISCRETION OF LECHIA, WE MAY REQUIRE YOU TO SUBMIT ANY DISPUTES ARISING FROM THESE TERMS OR OUR PRIVACY POLICY, INCLUDING DISPUTES ARISING FROM OR CONCERNING THEIR INTERPRETATION, VIOLATION, INVALIDITY, NON-PERFORMANCE, OR TERMINATION, TO FINAL AND BINDING ARBITRATION UNDER THE RULES OF ARBITRATION OF THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) APPLYING DELAWARE LAW. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration. The parties agree that the arbitrator shall NOT have the authority to award attorneys’ fees, unless otherwise expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration. The parties agree to arbitrate solely on an individual basis, and these Terms do not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Except as required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial.
Severability. If any provision of these Terms of Use shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
Waiver. No failure on the part of Lechia to enforce any part of these Terms of Use shall constitute a waiver of any of Lechia’s rights under these Terms of Use whether for past or future actions on the part of any person. Only a written waiver signed by a legal representative of Lechia will have legal effect.

Cost. The Sites are currently free, but Lechia reserves the right to charge for some or all services in the future. Lechia will notify you before any services you are then using become subject to a fee. If you thereafter continue to use such services, you must pay all applicable fees for such services.
Consent. The User hereby grants Lechia all consents required pursuant to any applicable law in any applicable jurisdiction, which may be required for the use by Lechia, its Related Parties, Affiliates and/or Service Providers, in accordance with these Terms of Use for the Personal Information processing in accordance with the Privacy Policy available at www.lechia.co.
Geographic Scope of the Sites. Lechia controls and operates the Sites from the United States of America.
Third Party Links. There may be hyperlinks on the Sites to Third Party Websites. These links are provided solely for the Users’ convenience. No information, material or content of third parties contained in, referenced by, included in, or linked to or from the Sites implies Lechia’s endorsement of the products, services or information of the third parties. Any information, data, opinions, recommendations, products or services provided by such third parties, whether through links to other websites or directly through their websites, are solely those of the third parties and not of Lechia. User’s use of Third-Party Websites is subject to the terms of use and privacy policies of those Third Party Websites.
Exclusion of Warranties regarding the Use and Functioning of the Sites and Links visible in it. The material available on the Sites is provided AS IS, without conditions or warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, User disclaims all conditions and warranties, express or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title and non- infringement. Lechia makes no warranty that (i) the Sites will meet User requirements; (ii) access to the Sites will be uninterrupted, timely, secure, free of viruses, worms, trojan horses or other harmful components, or free of defects or errors; (iii) the results that may be obtained from the use of the Sites will be accurate or reliable; or (iv) defects will be corrected. The User understands and agrees that any material and/or data downloaded or otherwise obtained through the Sites is used at User’s own risk and that User will be solely responsible for any damage to User’s computer system or loss of data that results from the download of such material and/or data., The material on the Sites may include technical inaccuracies or typographical errors and may be inaccurate or become inaccurate as a result of developments after their respective dates. Lechia undertakes no obligation to verify or maintain the currency of such information.
Lechia is not responsible in any way for those contents, commercial activities, products and services included that could be viewed through electronic links (links), directly or indirectly, through the Sites, especially those that could correspond to value-added content for the User, such as leisure, entertainment, curiosities, advice or others. The presence of links on the Sites, unless expressly stated otherwise, is merely for information purposes and in no case implies a suggestion, invitation or recommendation about them. These links do not represent any type of relationship between Lechia and the individuals or companies that own the websites that can be accessed through these links. Lechia reserves the right to unilaterally remove the links that appear on the Sites at any time.
Limitation of Liability. Subject to applicable law, under no circumstances shall Lechia, its Related Party, Affiliates and/or Service Providers, and each of their licensors or licensees, be liable to the User for any direct, indirect, special, incidental, consequential, punitive or other damages, including lost profits, personal injury (including death) and property damage, that may result from (i) the use of, or the inability to use, the Sites or any material on the Sites; (ii) the conduct of any other User or third party of the Sites; (iii) the unauthorized access to or amendment of the Personal Information of the User; (iv) and any other matter related to the Sites. Lechia shall not be liable even if Lechia or an authorized representative of Lechia has been advised of the possibility of such damages. These include but are not limited to damages or injury caused by error, omission, interruption, defect, failure of performance, delay in operation or transmission, line failure or computer virus, worm, trojan horse or other harmful component.
In the event that applicable law may not allow the exclusion of certain warranties or the limitation or total exclusion of liability in which case the above limitation of liability shall be construed to the maximum extent permitted by law.
Indemnification. User hereby agrees to indemnify and hold Lechia and its Related Party, its Affiliates and/or Service Providers, and each of their respective agents, licensees, successors and assigns, harmless from and against any and all claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses, including reasonable legal fees, relating to or arising out of your use of the website, any use of your User Submissions as permitted in these Terms of Use, and/or any breach or alleged breach of any of your warranties, representations or agreements hereunder.
Termination. The duration of the Terms of Use is indefinite. Notwithstanding the foregoing, Lechia may interrupt, suspend or terminate the provision of the service of the Sites or any of the services that comprise it, without expression of cause.
Assignment. User may not assign, delegate or transfer these Terms of Use or Users rights or obligations hereunder, in any way (by operation of law or otherwise) without Lechia’s prior written consent. Lechia may transfer, assign, or delegate these Terms of Use and our rights and obligations without consent.
Changes to the Terms of Use. Lechia may, from time to time, change or revise these Terms of Use, along with its products, at its sole discretion by updating this posting on the Site, and indicating the date of application of the new version of the Terms of Use. The date of the “Last Update” included at the end of this legal notice shall indicate when the changes have been made. Your use of the Site and your participation in the application process reaffirms your continuing agreement to the then-current Terms of Use. If you don’t agree with the new Terms of Use, you are free to stop using the Sites. If you use the Sites in any way after a change to the Terms of Use is effective, that means you agree to all of the changes.
Applicable Law and Jurisdiction. These Terms of Use, as well as the relation between User and Lechia, shall be governed by and construed in accordance with the laws of the State of Delaware.
Conflict Resolution. The User hereby (i) agrees that any action at law or in equity arising out of or relating to these Terms or Lechia’s Privacy Policy, including without limitation, the user’s use of the Services (including the Program), or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability to arbitrate such dispute, claim, or controversy, shall be filed only in the state or federal courts of Delaware, and (ii) consents and submits to the exclusive jurisdiction and venue of such courts. No action arising under or relating to these Terms or Lechia’s Privacy Policy may be brought by either party more than one year after the cause of action has occurred. AT THE SOLE DISCRETION OF LECHIA, WE MAY REQUIRE YOU TO SUBMIT ANY DISPUTES ARISING FROM THESE TERMS OR OUR PRIVACY POLICY, INCLUDING DISPUTES ARISING FROM OR CONCERNING THEIR INTERPRETATION, VIOLATION, INVALIDITY, NON-PERFORMANCE, OR TERMINATION, TO FINAL AND BINDING ARBITRATION UNDER THE RULES OF ARBITRATION OF THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) APPLYING DELAWARE LAW. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration. The parties agree that the arbitrator shall NOT have the authority to award attorneys’ fees, unless otherwise expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration. The parties agree to arbitrate solely on an individual basis, and these Terms do not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Except as required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial.
Severability. If any provision of these Terms of Use shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
Waiver. No failure on the part of Lechia to enforce any part of these Terms of Use shall constitute a waiver of any of Lechia’s rights under these Terms of Use whether for past or future actions on the part of any person. Only a written waiver signed by a legal representative of Lechia will have legal effect.
